شملہ معاہدے کی روح سے دونوں ممالک مسلئہ جموں کشمیراسے اقوام متحدہ سمیت کسی بھی عالمی فورم پر نہیں اٹھا سکتے

جموں کشمیر اقوام متحدہ کا ممبر ملک نہیں ہے

جموں کشمیر کا مسلہ پاکستان کے قباٸلی حملے اور ہری سنگھ کے الحاق ہندوستان کے بعد ہندوستان پاکستان کے خلاف اقوام متحدہ میں لیکر گیا جو کہ 13 اگست 1948 کی قراداد میں پڑھاجا سکتا ہے
اور یہ قراردادیں اقوام متحدہ کی دفعہ 35 کے چیپٹر 6 کے تحت آتی ہیں جو علامتی اور مصالحاتی قراردادیں ہیں
اور خلاف ورزی پران میں کسی بھی قسم کی طاقت کے استعمال کا حق نہیں ہے
1948 سے 1971 تک جموں کشمیر پر تقریبا 23 کے قریب قرار دادیں بنتی ہیں
جبکہ 7 قراردادیں سلامتی کونسل میں منظور ہوٸیں
1972 کے شملہ معاہدے کے تحت پاکستان اور ہندوستان نے اسے اقوام متحدہ سے نکال کر باہمی گفت و شنید سےحل کرنے کا عزم کیا


شملہ معاہدے کی روح سے دونوں ممالک مسلئہ جموں کشمیراسے اقوام متحدہ سمیت کسی بھی عالمی فورم پر نہیں اٹھا سکتے اور نہ ہی ان تمام معاہدات میں جموں کشمیر کے عوام کسی بھی طرح سے فریق ہیں جموں کشمیر پر سیز فاٸر لاٸن کو کنٹرول لاٸن کے ساتھ تبدیل کر دیا گیا
شملہ معاہدے کی توثیق 1999 کے اعلان لاہور میں کی گٸی جبکہ ہندوستان اور پاکستان نے MFN Treaty پر دستخط کر کے ایک دوسرے کو انتہاٸی پسندیدہ اقوام کا درجہ دہ چکے ہیں
پاکستان اور ہندوستان کے درمیان 42 سے ذاٸد معاشی سیاسی اور جنگی معلومات سمیت انتہاٸی اہم تجارتی اور دوستی کے معاہدات ہیں
جبکہ دونوں ممالک کے درمیان باہمی تجارت کا حجم 1.122$ بلین امریکی ڈالرز میں ہے جو کہ گزشتہ سات ماہ میں %5 بڑھا ہے
جموں کشمیر کے عوام کو جبری غلام اور ان کے بنیادی انسانی حقوق سے محروم رکھنے سمیت سیز فاٸر لاٸن پر باہمی رضامندی سے جموں کشمیر کے لوگوں گولیوں کا نشانہ بنایا جاتا ہے جبکہ واہگہ بارڈراور سیالکوٹ ورکنگ باونڈری پر ہر خوشی کے موقع پرگرمجوشی سے مٹھاٸیوں اور تحاٸف کا تبادلہ کیا جاتا ہے
جموں کشمیر کے لوگوں اور محب وطن قیادت (ایجنٹو کریسی نہیں) کو جموں کشمیر کے عوام کے مفاد کو اس کی قومی آزادی خود مختاری اور وحدت کی بحالی کے لٸے خود پراور اپنے عوام کے زور بازو پر جدوجہد کو تیز اور یقینی بنانا ہو گا
دنیا مسلہ کشمیر ہم سے بہتر سمجھتی ہے اس لیے ان کو سمجھانے سے قبل جموں کشمیر کی قیادت کو اپنا مسلہ خود سمجھ کر اور پھر اپنے لوگوں کو سمجھانے کی سب سے شدید ضرورت ہے
کیونکہ ہندوستان اور پاکستان کشمیریوں کو غلام منقسم اور مہقور رکھنے پر متفق ہیں
ہم کو بھی اپنی قومی آزادی کیلٸے متحد اور منظم ہونے کے علاوہ کوٸی راستہ نہیں
کیونکہ ایک خود مختار جموں کشمیر خطے میں امن ترقی استحکام اور خوشحالی کی ضمانت ہے
ہمھیں بھی امن سے جینے کا حق دیا جاۓ

جموں وکشمیر نیشنل عوامی پارٹی برطانیہ برانچ کے زیر اہتمام معاہدہ کراچی کے حوالے سے پروگرام کا انعقاد کیا گیا جس میں جموں کشمیر نیشنل عوامی پارٹی اولڈھم کے دوستوں نے بھرپور شرکت کی اجلاس سے خطاب کرتے ہوئے دوستوں نے معاہدہ کراچی کو مسترد کیا اور یہ مطالبہ کیا گیا کہ کشمیریوں کے وسائل کشمیری قوم کے حوالے کیے جائیں اجلاس سے ندیم اسلم واجد ایوب امجد اشرف نثار احمد خان راجہ عابد راجہ اویس حماد بیگ چودھری عارف زوہیب حسرت برکت الحسین شاہ دانش خان سیماب الطاف اور سروش خان نے بھی خطاب کیا اور اس عزم کا ارادہ کیا وطن کی آزادی خودمختاری خوشحالی استحصال سے پاک معاشرے کے قیام تک جدوجہد جاری رکھیں گے

قانون آزادی ہند کی دفعہ 7  (b-1/ 7) کے تحت معائدہ امرتسر(بکری پتر Sale Deed) اپنے مرگ آخریعنی اختتام کو پہنچ جاتا ہے، ہری سنگھ ریاست کا شخصی حکمران نہیں رہتا اورساتھ ہی اقتدار اعلی ریاست کے عوام کو منتقل ہو جاتا ہے

ریاستی عوام کی اپنے حقوق کیلئے لازوال جدوجہد ظالم اور درندہ صفت ڈوگرہ حکمرانوں کے خلاف پاکستان اورہندوستان کے قیام سے سالوں پہلے جاری تھی اور الحاق ہندوستان اور الحاق پاکستان کیلئے نہ تھی-

اسلیئے 4 اکتوبر کا عبوری حکومت کا اعلان اس اقتداراعلی کی عوام کو منتقلی اور بحالی کی توثیق کرتا ہے اور معائدہ امرتسر (بکری پتر Sale Deed) کے خاتمے کا بھی اعلان کرتا ہے-جو کہ قانون آزادی ہند کی رو سے ہماری قومی آزادی کی قانونی اور سیاسی بنیاد ہے -جس کی توثیق اقوام متحدہ کی قراردادیں بشمول ہندوستان اور پاکستان کے جموں کشمیر پرتمام دو طرفہ معائدات (شملہ ،اعلان لاہور وغیرہ، پاکستان کے آئین کی دفعہ 257 اور ہندوستان کے آئین کی دفعہ 370 بھی اس بات کی تائید کرتے ہیں کہ ریاست کے مستقبل کا فیصلہ بذریعہ رائے شماری ، ریفرنڈم یعنی
WILL OF THE PEOPLE OF JAMU KASHMIR
کے ذریعے ہی جموں کشمیر کے مستقبل کا فیصلہ ریاستی عوام ہی کر سکتے ہیں-

انگریزنے ہی 1947 کو مذہبی بنیاد پر پاکستان اورہندوستان کی تشکیل کی اور مذہبی منافرت کو اپنے سامراجی عزائم کیلئے بھرپور استعمال کیا – جس سے کشمیر بھی محفوظ نہ تھا- کانگرس اور مسلم لیگ کسی بھی صورت جموں کشمیر کو آزاد خود مختارملک دیکھنا نہیں چاہتے تھےاور ریاست کو ہر صورت اپنے ساتھ شامل کرنا چاہتے تھے- دونوں جماعتوں کشمیری قیادت پر براہ راست گہرا اثرو نفوذ تھا-جس کا مقصد 4 اکتوبر کے عوامی اور قومی آزادی کے اعلان کو سبوثازکرنابھی تھا جسکی تصدیق بعد کے واقعات، 22 اکتوبر کا قبائیلی حملہ،24 اکتوبر کو سردارابراھیم کا پاکستان کی ایماپر دوبارہ حکومت کی تشکیل اور26 اکتوبر1947 کو ہری سنگھ کا جعلی الحاق ہندوستان اور اسکے تناظر میں دیگر واقعات داراصل برٹش سامراج کے ایجنڈے کی تکمیل کا حصہ تھا- جو آج بھی ساوتھ ایسٹ ایشیاء میں وجہ تنازعہ اور غربت کی وجہ ہے-

جو لوگ بنیاد پرستی کے رحجانات کے زیراثر چار حصوں میں تقسیم جموں کشمیر پر دس لاکھ سے زائد غیر ملکی افواج ، خطر ناک بھاری اسلحہ کی موجودگی اورروزانہ اپنے محکوم عوام کیلئے کچھ کرنے سے معذورہیں اور قبیلہ پرستی کی لعنت کے زیر اثر نفرت کو فروغ دیکر کیا پاکستان اور ہندوستان کے قبضے کو ہی دوام تو نہیں دہ رہے ؟ اگران میں سچائی کی کوئی رمق ہے تو تخریب کاری کے بجائے تعمیری طور اپنی تنظیم اور پروگرام کوعوام میں لیکر جائیں- کیونکہ فیصلہ کن طاقت تو عوام ہی ہیں-جسکی یہ بات ہی نہیں کرتے- چہہ معنی وارد ؟

جموں کشمیر کی قومی آزادی،پاکستان اور ہندوستان کی افواج اور اسلحہ کا انخلا اسکی وحدت کی بحالی اور استحصال سے پاک ایک اشتراکی معاشرے کا قیام ہی ایک عوامی جدوجہد کی بنیاد ہو سکتے جو کہ نظریاتی برتری کو قائم رکھتے ہوئے ہی ممکن ہے -

Maqbool Bhat was a revolutionary who lived and died for the struggle of national liberation of Jammu Kashmir which is occupied by India, Pakistan and China. For his consistent struggle for the national liberation of Kashmir both India and Pakistan declared him an enemy. Both India and Pakistan punished, charged, arrested and penalised him for his struggle for his motherland divided, occupied Jammu Kashmir. He was a freedom fighter and hero for the followers of his struggle, those who believe in a United Independent and prosperous Kashmir He was born on 18th February 1938, in Indian Occupied Kashmir(IOK) and was killed by hanging on 11 February 1984 at the age of nearly 46 years old, by a verdict passed by Indian supreme court under section three (3) of “Enemy Agents Ordinance 1943. RETURN MAQBOOL BHAT`S MORTAL REMAINS A CHALLENGE FOR DEMOCRATIC, SECULAR INDIA

Maqbool Bhat was a revolutionary who lived and died for the struggle of national liberation of Jammu Kashmir which is occupied by India, Pakistan and China. For his consistent struggle for the national liberation of Kashmir both India and Pakistan declared him an enemy. Both India and Pakistan punished, charged, arrested and penalised him for his struggle for his motherland divided, occupied Jammu Kashmir. He was a freedom fighter and hero for the followers of his struggle, those who believe in a United Independent and prosperous Kashmir He was born on 18th February 1938, in Indian Occupied Kashmir(IOK) and was killed by hanging on 11 February 1984 at the age of nearly 46 years old, by a verdict passed by Indian supreme court under section three (3) of “Enemy Agents Ordinance 1943. (A definition): 2(b) "Enemy Agent" means a person, not operating as a member of an enemy armed forces, who is employed by, or work for, or acts on instructions received by the enemy. Prior to being sentenced to death by hanging he was also subject to an earlier death sentence and other criminal charges against him were still valid. He petitioned to the President of India Giani Zail Singh for clemency on the grounds of an unfair trial. On February 6, 1984, JKLF members murdered the Indian diplomat Ravinder Mahatre, in Birmingham, UK. One of their primary demands of JKLF was the release of Maqbool Bhat. After this, Maqbool Bhats petition for clemency was rejected, and Bhat was executed in the Tihar Jail in New Delhi India on February 11, 1984. Farooq Abdullah was the chief minister of Indian occupied Kashmir (IOK) who signed the black warrant for Maqbool Bhats execution in 1984. After execution he was buried inside the area of Tihar Jail in New Delhi India. He was a martyr for his followers of national liberation movement and he was inspired by the great revolutionary leader Ernesto Che Guevara .He believed “A revolutionary may die but never the revolution “. His message to resist the occupation of India Pakistan widely spread and Kashmiri youth took on the streets on 11 day of February every year not only inside Kashmir but all around the world. He is a martyr for them and they want to join his struggle for national independence and want to build a society (without poverty and exploitation) on the basis of equality and prosperity. Many campaigns are trying to claim the remains of Maqbool Bhat. Once reclaimed to remove them from Tihar Jail New Delhi India to Kashmir, to give his mortal remains a respectable burial suitable for a martyr hero of the nation with full respect, dignity and honour. He will always live in the hearts and minds of his people, followers and all those who believe in, Justice, liberation, independence, humanity and equality. His only crime was that he wanted to liberate Jammu Kashmir from the brutal clutches and military occupation of India and Pakistan. After his execution his mortal remains still remain in the prison at Tihar Jail in New Delhi India. Post to his death he was entitled to be buried with the will and wish of his family and followers of his movement of national liberation of Kashmir and according to their religious and cultural beliefs as are all executed persons, this right was not and still is not allowed to Maqbool Bhatt’s remains. India is one of the largest democratic, secular countries in the world. For India to fail to release the Maqbool Bhat mortal remains is against the norms of Indian democracy ,secular values and fundamental human rights locally, regionally and internationally to comply with the demand to shift Maqbool Bhat`s mortal remains to Kashmir will help to increase the grace of Indian democracy regionally and in the world. As a Kashmiri, we invite all those who believe in, support and respect fundamental human rights to put pressure on Indian government to release the mortal remains of Maqbool Bhat Shaeed from Indian prison to Kashmir. An Independent Kashmir is the best solution for the regional peace and security and world peace at large. Maqbool Baht is a hero and symbol of national liberation struggle in Kashmir against the brutal military occupation of India-Pakistan.

AJK INTERIM ACT 1974 AND HUMAN RIGHTS,BY NADEEM

My submissions are as under: In 2010 the 18th Constitutional Amendment on Federation-Provinces Relations legislative and administrative responsibilities of the provinces in Pakistan, enables civil society of AJK to speak and proposed amendment’s in the AJK interim Act 0f 1974.Various NGO`S come forward and suggest their amendment’s to the AJK act 1974. AJK interim Act 1974, is a Pakistan`s colonial design for the people of Azad Kashmir (POK) to deprive them from the their fundamental rights and resources. The scope and aim of the Act is to protect the defacto occupational interests of military and civil establishment of Pakistan. The main aim of this legal frame work is to well control to the indigenous thoughts and struggle which represent the real interests of the people for their demand of national independence from Pakistan. The Kashmir council, ministry of Kashmir affairs to force the people of Azad Kashmir to believing Kashmir state accession to Pakistan, It is a crime if any Kashmir speaks, write against the occupied military of Pakistan and its agencies. These agencies are so powerful and above the preventive law in AJK. There is very low chances that people will empower through the amendments in AJK interim act 1974.Beacuse its design to support the Pakistan military occupation in AJK.There is no way to make military establishment accountable via this act AJK judiciary and the legislature prove that they are the subservient of the GCO Muree and Islamabad. If we check progress of prosperity of life in AJK then its fail to prove that its progress is improving in any field of daily life. Injustice, corruption, unemployment, health, merit etc,its fail to achieve any substantial progress. The budget amount of AJK (nearly 56 Arab in Pak Rupee) is les then the amount spending CDA Islamabad Pakistan, the population of AJK is less than the Rawalpindi division of Pakistan. So the indigenous people those are standing to liberate the AJK,GB out rightly rejected the Act 1974.They want liberation (Azadi) and withdrawal of Pakistan army (weapons) from the territory of Kashmir .So there is no chance to enhance and propose any amendments which empower and protect the fundamental rights of the state subject holders of Kashmir . Because Pakistan is an author of this defacto document since 1966 to 2012.The various articles in Act 1974 are contrary to the fundamental human rights. As an estimate Government of Pakistan (WAPDA) owes around 255 billion rupees of profit of Mangla Dam to AJK since 1966. To understand the jurisprudence of the unlimited freedom of civil liberties and how people defend and protect their indigenous national and international fundamental rights. LAWS ENACTED BY THE GOVERNMENT OF AJ&K 1 1966 The AJ&K Grant of Khalsa Wastc Land as Shamlat Deh Act, 1966. (Act I of 1966) TO---------------- 2009 The AJ&K Mangla Dam Housing Authority Act, 2009 (Act I of 2009) 2-Kashmiris are not a part of any UN resolutions and any bilateral Shimla Agreement which turn Kashmir a bilateral territorial dispute between India and Pakistan. Around 28 UN resolutions including the Shimla Agreement 2 July 1972 (between Z.A Bhutto and Indra Gandhi)and Elan-E-Lahore in 1992 (between A.B.Bajpi and Nwaz Sharief).India Pakistan are free to decide regarding Kashmiris in the name of regional peace and security. 3--The amendments (1-20) in the constitution of Pakistan were taken place during the struggle of the people of Pakistan past sixty years many lost their precious life during this struggle for the rule of law. Articles from 8-28 in the constitution of 1973 of Islamic republic of Pakistan cover the human rights. Where is any safeguard in AJK for the protection of fundamental rights? 4- Reaching up to the 18th - 20th amendments there was a Charter of Democracy on February 21, 2010 The 36 points Charter of Democracy signed by Benazir Bhutto(late) and Nawaz Sharif on May 14, 2006 in London UK. Remember Gen. Musharaf forced exile both former Prime ministers of Pakistan Benazir Bhutto and Nawaz Sharif (Now the prime minister of Pakistan) 5-Magna Carta also called Magna Carta Libertatum or The Great Charter of the Liberties of England, originally issued in Latin on 15 June 1215. 6- THE UN GENERAL ASSEMBLY PROCLAIMS THIS UNIVERSAL DECLARATION OF HUMAN RIGHTS On 10 December 1948 as a common standard of achievement for all peoples and all nations, to the end that every individual and every organ of society, keeping this Declaration constantly in mind, shall strive by teaching and education to promote respect for these rights and freedoms and by progressive measures, national and international, to secure their universal and effective recognition and observance, both among the peoples of Member States themselves and among the peoples of territories under their jurisdiction. 7-The European Convention on Human Rights The Governments signatory hereto, being Members of the Council of Europe, Considering the UNIVERSAL DECLARATION OF HUMAN RIGHTS proclaimed by the General Assembly of the United Nations on 10 December 1948. COUNCIL OF EUROPE, the European Convention on Human Rights ROME 4 November 1950, And its Five Protocols, PARIS 20 March 1952, STRASBOURG 6 May 1963, STRASBOURG 6 May 1963, STRASBOURG 16 September 1963, STRASBOURG 20 January 1966. To adopt and enhance a broader concept of human rights and accepting the fundamental right of independence and Kashmiris control of their own affairs and quash the status quo which maintain by the Pakistan and India and their proxies , subservient in all parts of divided occupied Kashmir .To accept the fundamental right to live as an independent country side by side with their neighbors peacefully without the presences of military and nuclear weapons .To subscribe broader approach is in a larger interest of Pakistan, India , Kashmir and the world at large. People of the region need a food, shelter, health and basic necessities of life. United, Independent, and socialist Kashmir is a best alternative solution for Kashmiris.

PAKISTAN: Another human rights defender was allegedly extrajudicially killed by the state intelligence agency AHRC-UAC-073-2013-01.jpg Mr. Sardar Arif Shahid Urgent Appeal Case : The Asian Human Rights Commission (AHRC) has received information that a human rights defender and writer from the Pakistani part of Kashmir, Sardar Arif Shahid, was gunned down in front of his house in the garrison city of Rawalpindi. Before his murder he has been arrested and then released at his native town when he visited the area along with some Kashmiri non Muslim visitors from the Jammu part of Indian Kashmir. His passport was confiscated and his name was put on the exit control list in 2009. The High Court has gave him relief in December 2012. CASE NARRATIVE: Mr. Sardar Arif Shahid, Chairman of the National Liberation Conference (NLC) and the Chairman of the All Parties National Alliance (APNA), was assassinated by unknown persons in the late evening of May 13, when he approached his house. According to his driver, Rizwan Khan, when they reached Sardar's home the driver went to open the gate of the house and suddenly he heard the sound of gun shots. As he turned towards the sound he saw Sardar had fallen in a pool of blood. Sardar was quickly taken to the military hospital in Rawalpindi where he succumbed to wounds. Sardar was assassinated on the same day as another human rights defender, Mr. Abdul Waheed Khan, who was assassinated in Karachi. These murders occurred exactly two months after the killing of Ms. Perveen Rehman in Karachi. Sardar was a prominent writer and human rights activist and had written two books on the peoples' struggle of the Kashmiris of both sides -- India and Pakistan. The APNA of which he was chairman has links in both Kashmirs. The APNA was a campaigner for the independence of Kashmir from India and Pakistan. This organization was developed in parallel with the All Parties Hurriayat Conference of Indian Jammu and Kashmir which was patronised by the Pakistan government. It is believed that he was assassinated by the agents of the notorious intelligence agency of Pakistan, the ISI, as he was always receiving threats from the ISI not only in Pakistan but also in Kashmir. Mr Sardar was a vocal critic of Pakistan's alleged role in sending militants to fight a "proxy war" against India in Indian-administered Kashmir. He also criticised Pakistan's policy of treating Kashmir as its "colony" and was opposing the occupation of Pakistan in Kashmir and Gilgit-Baltistan. The Pakistani government banned him from travelling abroad in 2009, and later confiscated his passport and other identification documents. The Ministry of the Interior told a court in December 2012 that his documents had been confiscated due to his "anti-state activities and on the recommendation of the director-general of the ISI intelligence service". Three months ago, police in Rawalpindi registered a case against him for publishing a monthly magazine which is alleged to have contained anti-Pakistan material. He was given pre-arrest bail by the court in that case. Some months ago a delegation of non Muslim leaders of Indian held Jammu, came to visit Pakistani Kashmir (Azad Kashmir). Sardar received the delegation at Mirpur, his native place in Pakistani Kashmir, where he was arrested by the ISI and held in jail. After he was released he went back to Rawalpindi, Punjab, where an Anti-Pakistan case was lodged against him. His activities were not liked by the state intelligence agencies as he was opposing the policies of Pakistani establishment against Kashmir. After his assassination protests against his killing was observed in both the parts of Kashmir and other parts of the world where Kashmiris are residing. ADDITIONAL INFORMATION: Human rights defenders have also been subjected to targeted killings by non-state actors, groups and individuals who opposed their work. While these are crimes in domestic law, under international human rights law the state also bears responsibility if it does not exercise due diligence, that is, if it fails to prevent such abuses or to ensure that the perpetrators are brought to justice. Human rights defenders -- be they journalists investigating and documenting wrongdoings of state agents, lawyers representing victims of human rights abuses in court or human rights activists campaigning to end human rights violations -- have been subjected to a range of human rights violations themselves. They have been harassed, arbitrarily arrested and detained, subjected to enforced disappearance, torture and extrajudicial killings. Contrary to the spirit of the UN Declaration on Human Rights Defenders, state agents have committed such violations at a recently increased rate, and with impunity. This crackdown on human rights defenders has happened at a time when human rights violations are reported from Balochistan at an ever increasing rate, making the role of human rights defenders in supporting victims, campaigning for legal redress for abuses and working to end abuses more essential than ever. The violence against human rights defenders and civil society organizations is rising by the state and Muslim groups which indicates a failure on the part of the government to provide protection to human rights defenders. Journalists who work on human rights issues remain the prey of state and both state actors and Muslim extremist groups including the Taliban. So far 87 journalists had been killed in Pakistan since 2000. In the year 2012, eight journalists were killed while performing their official duty. During the first two months of this year alone, three journalist has been killed. SUGGESTED ACTION: Please write the letters to the following authorities calling on them to initiate a high powered inquiry into the murder of Sardar Arif Shahid which was allegedly done by the state intelligence agencies. Please urge them to take strong action against the state intelligence agencies particularly the ISI who is the main source of abduction, torture and extrajudicial killings of the Kashmiri people. Please also urge them to arrest and punish all those involved with the conspiracy and murder of Arif Shahid, stop the policy of harassment and intimidation in Pakistani Administered Kashmir and Gilgit Baltistan and urge the government to allow the people of Pakistani Administered Kashmir and Gilgit Baltistan to enjoy their fundamental human rights; the government must immediately pay compensation to his family members. The AHRC is writing separate letters to the UN Special Rapporteurs on the Extra-judicial, Summary, or Arbitrary Executions and on the situation of human rights defenders calling for their intervention into this matter.
