MEMORANDUM
Presented to the Indian Consulate General on the 27th October 2010 in Birmingham:

We the undersigned leaders of Jammu Kashmir National Independence Alliance (JKNIA)
representing different Kashmiri parties amongst the British Kashmiri diaspora are here to
remind you through this memorandum that 63 years ago on this 27th day of October troops
of your country were illegally airlifted into Srinagar, the summer capital Jammu Kashmir and
are since in occupation and have caused death and destruction in our divided country.
While your government justifies the presence of troops in Kashmir on the grounds that the
then ruler of Kashmir signed an instrument of accession with your country which is a claim not
only challenged by us the State Subjects of Jammu Kashmir but is also contested by several
academic scholars of international repute. Even if we oversight the disputed nature of the
accession instrument your country still do not have any legitimate basis for your troops in our country.
With this regard we would like to draw your attention to the following statements by the
founding Prime Minister of your country and an internationally respected leader who was also
the head of Indian National Congress, the very party you are currently representing as the
Prime Minister of India, Mr Juwar Lal Nehru.
"We have declared that the fate of Kashmir is ultimately to be decided by the people.
That pledge weHave given not only to the people of Kashmir but to the world. We will not and cannot back out of it.
We are anxious not to finalise anything in a moment of crisis and without the fullest
opportunity to beGiven to the people of Kashmir to have their say, it is for them
ultimately to decide.
" (Jawaharlal Nehru broadcast to nation - All India Radio, 2 Nov. 1947).
"We have given our pledge to the people of Kashmir and subsequently to the United Nations. We
Stood by it and we stand by it today. ~let the people of Kashmir decide." (Jawaharlal Nehru
Statement in the Indian Parliament, 12 Feb. 1951).
"We have taken the issue to United Nations and we have given our word of honour for a peaceful Solution. As a great nation we cannot go back on it. We have left the
question for final solution to the
People of Kashmir and we are determined to abide by their decision and conscience.
" (Jawaharlal Nehru 2nd January, 1952, Amrit Bazar Patrika).
As you can see from the dates of these statements they were issued well after the so called accession and were not only given to the people of Kashmir but to the world. We remind you once again the pledges made by your first Prime Minister and demand your government to play your part in the resolution of Kashmir question according to the historical pledges you as a country made and the aspirations of Kashmiri people across the division line that divides our country under the occupation of your troops and our other neighbour Pakistan. The immediate steps we demand from you include:
1.Complete cessation of military and paramilitary action by Indian forces against the people of Jammu Kashmir;
2. Removal of all bunkers, watch towers and barricades set up by the Indian military and paramilitary forces in towns and villages;
3. Unconditional release of all those imprisoned in connection with resistance to the Indian occupation;
4. Immediate revocation of all the draconian laws;
This must be followed by the following long term measures to resolve the Kashmir Question according the will and wishes of the people of Kashmir:
1.
Withdraw all foreign forces from all parts of Kashmir state;
2.
Release of all political Prisoners including the mortal remains of the leader of national independence and unification movement Mohammed Maqbool Bhatt from Tihar prison Delhi;
3.
Complete freedom of trade and movement across the division line and internationally for all the State Subjects ;
4.
Freedom of Press and Assembly ;
5.
Removal of all restrictions on the politics of independence for free and fair elections in the entire state for regional assemblies and a national assembly;
6.
Making necessary arrangements for Self Determination including and with the right to independence through a fair, free and democratic mechanism.
